General Terms and Conditions

Our events are individually tailored to our customers. They should be a success - our customers should be satisfied. In the event of disagreements, we will work together to find solutions. The following rules shall apply:

 

1. Conclusion of the contract

The contract is concluded as a service contract between SCHÖNLEBER 1848, Mr. Walter Schönleber (contractor) and the client. If the client is represented when the contract is concluded, the representative shall be liable alongside the client for compliance with the contract.

If the client is a majority of persons, each of them shall be liable for all obligations arising from the contract as joint and several debtor.

The client shall receive an individual offer from SCHÖNLEBER 1848. He accepts this offer by returning the signed booking form. The contract is thereby concluded. A further confirmation by SCHÖNLEBER 1848 is not required for the conclusion of the contract.

The contract is also concluded when Fa. SCHÖNLEBER 1848 allows an interested party to participate in an event.

 

2. payment deadlines

The client shall pay 50% of the agreed total price upon booking. The remaining amount is to be paid one week after the service has been provided.

 

3. withdrawal by SCHÖNLEBER 1848

If the payment mentioned under 2. is not received within 14 days after booking, SCHÖNLEBER 1848 is entitled to withdraw from the contract. Cancellation costs shall be incurred in accordance with No. 4 of these terms and conditions. The client/participant is permitted to prove that the damage is lower.

If the set minimum number of participants is not reached, SCHÖNLEBER 1848 has the option of withdrawing from the contract. Withdrawal must be declared at least 2 weeks before the start of the event. If the contract is only concluded within the 2 weeks before the start of the event, withdrawal is possible up to the day before the event. In the event of such withdrawal, the client shall receive a full refund of any amounts already paid.

 

4. Withdrawal by the participant

Cancellation by the client is possible at any time. Cancellation fees will be charged. Withdrawal must be declared in writing (e-mail or fax). If the participant is a group, withdrawal is only possible for all participants together.

If the client withdraws, SCHÖNLEBER 1848 is entitled to charge an expense allowance or processing fee, plus the actual costs incurred, without proof of damage.

If the client declares the withdrawal before the time scale listed below occurs, the compensation shall amount to a flat rate of 15% of the agreed total price.
If the client declares his withdrawal within the following time scale, the following cancellation fees shall apply:

8 to 6 weeks before the start of the event: 40% of the total price

up to 5 weeks before the start of the event: 50% of the total price

up to 4 weeks before the start of the event: 60% of the total price

up to 3 weeks before the start of the event : 70% of the total price

up to 2 weeks before the start of the event : 80% of the total price

within 2 weeks before the start of the event: 100% of the total price

The participant is permitted to prove that the damage is lower.

The date of receipt of the withdrawal by SCHÖNLEBER 1848 is decisive for the running of the deadlines.

Until the start of the event, the participant may demand that a third party assumes the rights and obligations arising from the contract in his place. SCHÖNLEBER 1848 may object to the entry of the third party if the third party does not meet the requirements of the event or if legal regulations conflict with this. If a third party enters into the contract, he and the previous participant are jointly and severally liable for the total price and the additional costs incurred by the entry of the third party.

 

5. Changes to services

SCHÖNLEBER 1848 reserves the right to make changes and deviations to individual services insofar as they appear necessary and have not been brought about by it in bad faith. The changes or deviations must not be significant and must not impair the overall character of the event.

Change requests of the participant will be taken into account as far as possible. SCHÖNLEBER 1848 has the right to charge a processing fee of €15 as well as the additional costs associated with the change.

If the event cannot be carried out or can only be carried out with difficulty or danger due to force majeure, in particular adverse weather conditions, technical problems or unforeseeable events, both contracting parties have the option of canceling the event. The contracting parties shall then mutually agree on a possible reduction of the event price.

 

6. limitation of liability

Participation in the event is at the participant's own risk. The liability of SCHÖNLEBER 1848 for contractual breaches of duty and tort is limited to intent and gross negligence. This does not apply to injury to life, body and health of the participant.

Insofar as SCHÖNLEBER 1848 is liable for other damages, its liability is limited to three times the (personal) event price. This limitation of liability also applies if the damage was caused by the fault of a third party arranged by SCHÖNLEBER 1848.

When arranging third-party services, SCHÖNLEBER 1848 is liable for the proper arrangement, not for the proper performance of the service by the third party.

The time details (departure/return) are approximate. It is possible to deviate from them. In particular, a journey time or the return may be delayed. SCHÖNLEBER 1848 cannot be held liable for any difficulties arising from this, in particular for missed connections to means of transport such as airplanes, trains, buses, ferries, ships, etc. SCHÖNLEBER 1848 cannot be held liable.

 

7. routes, weather and clothing

Participation in the event is at your own risk. The event may take place entirely or partially in the open air. Paths and buildings may be impassable. Participants must ensure that they are dressed appropriately for the weather, and in particular that they wear suitable footwear. Participants are required to exercise particular caution on rough terrain and in old buildings.

The event will be held even if the weather is bad or appears unsuitable to the participant. In this case, the participant has no right of withdrawal. The participant is free to agree on a possible alternative program upon conclusion of the contract. Without such an agreement, SCHÖNLEBER 1848 is not obliged to provide an alternative program.

 

8. Instructions

During the event, the instructions of SCHÖNLEBER 1848 must be followed. Otherwise, SCHÖNLEBER 1848 has the option to exclude the respective participant from the event or to cancel the event altogether. SCHÖNLEBER 1848 also has the option of excluding a participant who is under the influence of alcohol or intoxicants from the event.

Smoking is not permitted in the vehicles. Seat belts must be worn.

 

9. Validity

These terms and conditions apply to all business transactions between SCHÖNLEBER 1848, Walter Schönleber and the participant. The GTC shall apply to subsequent contracts even if they are no longer expressly mentioned therein. They shall also apply if the participant refers to his own terms and conditions, unless these have been expressly agreed.

 

10. Place of jurisdiction/place of performance

If the Client is a merchant or a legal entity under public law, the place of performance and jurisdiction for all disputes arising from this contractual relationship, including bill of exchange and check processes, shall be the registered office of the Contractor (65375 Oestrich-Winkel, District Court 65385 Rüdesheim). The same shall apply if the Client has no general place of jurisdiction in Germany.

The law of the Federal Republic of Germany shall apply.

 

11. General information

As part of the order processing, the client's data will be stored (notification in accordance with § 33 BDSG).

The ineffectiveness of individual provisions of these terms and conditions or of the concluded contract shall not result in the ineffectiveness of the entire contract.
